【賛同しました】「新サービス貿易協定(TiSA)」案に向けた交渉に強い反対を表明

115か国以上の市民団体が懸念を表明しています。
公共サービスに、貿易は不要です。
これもTPPと同じく秘密交渉となっており、情報公開を求めます。

下に署名する私たち市民社会組織は、世界各国のメンバー数億人を代表し、広範囲にわたる多国間の「新サービス貿易協定(TiSA)」案に向けた交渉に強い反対を表明します。

•交渉に参加する、「(サービス業)の真の友達(Really Good Friend、RGF)、すなわち、オーストラリア、カナダ、チリ、コロンビア、コスタリカ、香港、アイスランド、イスラエル、日本、メキシコ、ニュージーランド、ノルウェー、パナマ、パキスタン、ペルー、韓国、スイス、台湾、トルコ、米国、EU28カ国に対し、交渉の中止を訴えます。
•参加していない国には、交渉に強い反対を表明し、将来的にもTiSAに参加しないことを誓うよう訴えます。

TiSA交渉は一般的に、「貿易」協定を利用して、各国に極端な自由化と規制緩和の方針に従わせるという企業アジェンダを追求するもので、労働者、農民、消費者、環境を犠牲にして企業利益を高めることが意図されています。協定案は、銀行、エネルギー、保険、電気通信、輸送、水、その他サービス部門の多国籍企業が、米国サービス業同盟(USCSI)や欧州サービスフォーラム(ESF)といったロビー団体との協力を通じて、体系的なアドボカシー活動を行なってきた結果、生まれたものです。金融、経済、社会、環境分野の危機的状況にもかかわらず、TiSAで提案されるサービスルールは、世界貿易機関(WTO)のサービスの貿易に関する一般協定(GATS)、および自由貿易協定(FTA)に盛り込まれた、政府の措置を「統制」し、規制のためのポリシースペースを制限するルールを増殖させ、大きく拡大します。

公共・民間両部門がサービスを確実に規制・監督することは民主主義、公益、開発、そしてサービス市場の秩序ある機能の実現に大事な要素です。私たちは、こうした価値や目標が、TiSA案によって大きく損なわれるのではないかと危惧しています。

金融(銀行、証券取引、会計、保険を含む)、エネルギー、教育、保健医療、小売、運送、電気通信、司法業務、輸送、観光といった重要な部門の政策立案が、その政策を受け入れなければならない人々の手の届かないところでなされるとき、民主主義が侵害されます。こうした問題の国内政策を決定していかなければならないのは、規制を削減し、企業利益を明らかに優先する傾向のある無責任な「貿易」交渉者ではなく、国内の規制当局や国、地方、州、自治体の監督委員会なのです。

金融部門と資本の規制緩和は、1990年代のGATSとFTAで一部奨励されてきましたが、これにより、昨今の世界金融危機が発生し、世界を不況の波が襲いました。多くの人々が失業や緊縮財政政策に苦しみ続ける現状を考えると、金融部門の再規制は、安定性を再構築し、将来的な金融・経済危機を未然に防ぐために不可欠であることがわかります。

議会は再規制の方向に向いていますが、私たちは、市場アクセスに関するGATS16条と国内規制に関する6条など、規制緩和に向かうGATSのようなルールをサービス部門に追わせるRGFの姿勢を非難します。私たちは、既存のGATSおよびFTAルールを超える許可基準、技術基準その他国内規制(国内外のビジネスに影響を与える規制も)について、新たな部門横断的制限を導入する計画にも反対します。

私たちは、市民、議員、労働組合、監督機関、サービス利用者その他利害関係者が、交渉権を定める人、または交渉そのもの、交渉文書を利用する機会が限られるか、全く利用できなくなる一方で、企業はアジェンダを策定し、交渉文書を簡単に利用できるというTiSA交渉の秘密的な性格を非難します。TiSA案をめぐる交渉においては、交渉内容を文書として公開し、監督機関、公共サービス事業者・利用者、議員、州および地方官僚、市民社会組織を定期的に交渉に招かかなければならないと私たちは主張します。議会と法律ではそうした交渉に拘束力のある条件を定めなければならず、また、条件の施行は、選挙で選ばれた役人による全面的な投票によって決定されなければなりません。

TiSA案は、サービス部門への外国投資が、実際には公共の目的や持続可能な経済を促すためにはなっていないことから、公益に対する攻撃であると言えます。私たちは、保健医療、保険、水、エネルギー供給、郵便、教育、公共輸送、衛生その他の基本的サービスが、利潤のみを追求し、市場相場を払うことができる人のみに利用を限定するような民間企業や外国企業に譲渡された場合に、サービスの弱体化が進むのではないかということを特に恐れています。したがって、官民双方の事業者が共に業務を行うもの、民間事業者と競合するもの、利用料を徴収するものも含め、基本サービスは、閉鎖された環境やTiSAなど無責任な貿易交渉のもとで提供されるべきではないと考えます。

私たちは、人権や労働権について法的な保護が保証されないまま、いわゆる自然人、すなわち移民労働者の一時的な移動の自由化を奨励するというTiSA案の意図を非難します。労働者の移動は、貿易協定の範疇外であり、国際労働機関(ILO)の規範である三者間の枠組みの一貫として扱われなければなりません。

TiSA案は、参加しない国にも脅威を与えます。EUと米国は、交渉の「多国間化」を意図していると明言しました。私たちは、EUと米国が、TiSAの行き過ぎた規制緩和・民営化方針を世界の「基準」に定め、他国、とりわけWTOに加盟する可能性がある国に参加の圧力をかけると決めたことについて、警戒を呼びかけます。さらに、TiSAが締結された場合、署名国がWTO内でサービス(GATS)交渉におけるブロックとなり、他国にTiSA水準の自由化と規制緩和を強いる恐れがあるとも考えられます。これにより、WTO加盟国がコンセンサスで合意したサービス交渉のガイドラインに違反する可能性が高まります。私たちはさらに、TiSAが、非対称性の存在や不公正な農業ルールなど、途上国の懸念に対処するためにWTOドーハ開発アジェンダでなされた約束を無視し、先進国企業が手に入れたいサービスのリストを実現の方向に推し進める試みであると非難します。

世界は未だ、金融業界の行き過ぎた規制緩和に促された今世紀最大の景気低迷から、回復途上にあります。サービスを確実に公的に監督することは、指摘利益よりも公益を優先することを約束するうえで必要なのは明らかです。私たちは、各国を確実に誤った方向に導くTiSAに反対します。
